PGCG Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before using the services provided by PGCG ("PGCG", "we", "us", or "our"). By submitting items to PGCG or using our website and services, you agree to be bound by these Terms and our Privacy Policy.

1. Grading Services

PGCG provides third-party submission ("middleman") services for trading card, comic, and collectible grading.

By submitting items to PGCG, you acknowledge and agree that:

  • PGCG facilitates the submission of your items to independent grading companies on your behalf.
  • PGCG does not determine, influence, or guarantee the grade assigned to any submitted item.
  • All grading decisions are made solely by the relevant grading company.
  • Quoted turnaround times are estimates provided by the grading company and are accurate to the best of our knowledge at the time your order is placed.
  • Turnaround times may change, be delayed, or exceed estimates due to factors outside PGCG's control, including delays by the grading company, shipping carriers, customs, or other unforeseen circumstances.
  • Refunds or credits will not be provided because a grading company exceeds its estimated turnaround time.

2. Submission Requirements

By submitting items for grading, you confirm that:

  • You are the legal owner of the submitted items or are authorised to submit them.
  • All information provided with your submission is accurate and complete.
  • Your items comply with all applicable laws and do not infringe the intellectual property rights or other legal rights of any third party.

PGCG reserves the right to refuse any submission that we believe is counterfeit, illegal, unsafe, or otherwise unsuitable for submission.

3. Payments & Fees

You agree to pay all applicable fees associated with your submission.

  • Pricing varies depending on the grading service, grading company, and number or type of items submitted.
  • Payment is required before your submission is processed unless otherwise agreed in writing.
  • Once your items have entered the grading process, all fees are non-refundable.
  • You must provide valid and accurate payment information when placing an order.
  • PGCG reserves the right to refuse or cancel any order if fraudulent or unauthorised payment activity is suspected.

4. Shipping, Risk & Insurance

PGCG takes reasonable care when handling customer items; however:

  • Customers are responsible for packaging items securely when shipping them to PGCG.
  • Risk of loss or damage during transit to PGCG remains with the customer until the items are received by us.
  • Items are shipped to and from grading companies using carriers selected by PGCG unless otherwise arranged.
  • While reasonable care is taken during handling and shipping, PGCG is not liable for damage, loss, theft, or delays caused by shipping carriers, customs, or grading companies.
  • Customers are encouraged to arrange appropriate shipping insurance where available.

5. Grading Company Decisions

PGCG is not responsible for:

  • The grade assigned by a grading company.
  • Authentication outcomes, including items deemed altered, counterfeit, restored, or ineligible for grading.
  • Labelling errors, holder defects, or other issues originating from the grading company.

Any concerns relating to grading outcomes will be addressed with the grading company where appropriate, but PGCG cannot guarantee changes or compensation.

6. Intellectual Property

All content on the PGCG website, including logos, trademarks, graphics, text, and other materials, is owned by or licensed to PGCG and is protected by applicable intellectual property laws.

You may not reproduce, copy, distribute, or use any PGCG intellectual property without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by Australian law:

  • PGCG is not liable for any direct, indirect, incidental, consequential, or special damages arising from the use of our services.
  • This includes, but is not limited to, loss of profits, loss of business opportunity, loss of data, delays, grading outcomes, or damage occurring during shipping or grading.
  • Where liability cannot be excluded under the Australian Consumer Law, PGCG's liability is limited to the resupply of the services or the cost of resupplying the services, where permitted by law.

Nothing in these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law that cannot legally be excluded.

8. Indemnity

You agree to indemnify and hold harmless PGCG, its owners, employees, contractors, affiliates, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your breach of these Terms.
  • Your submission of items that infringe intellectual property rights or violate any law.
  • Any dispute relating to ownership or authenticity of submitted items.

9. Termination of Services

PGCG reserves the right to refuse service, suspend processing, or terminate access to our services at any time if:

  • These Terms are breached.
  • Fraudulent or unlawful activity is suspected.
  • A submission is considered inappropriate or unsafe.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or the services provided by PGCG will be subject to the exclusive jurisdiction of the courts of Victoria.

11. Changes to These Terms

PGCG may update or modify these Terms from time to time without prior notice.

The latest version will always be published on our website, and continued use of our services constitutes acceptance of any updated Terms.
